Criminal complaint and legal standing

Considering the odd reclassification of the crime, the illegal plea agreement, and Duarte’s public statements, we deemed the case unlawfully solved due to a bribe from Javier Duarte to the heads of the AGO. Therefore, in October 2018, we filed a criminal complaint reporting possible bribery.

In our complaint, we demanded that the prosecutors recognize our legal standing as victims of corruption-related crimes. Legal standing would allow us to enforce our right to defend human rights and participate in public affairs, particularly corruption-related ones. It would also allow us to intervene in criminal proceedings, collaborate with the investigation, and prevent impunity by appealing unlawful decisions by prosecutors and judges.

To support this demand, we argued that reported corruption-related crimes affected collective rights, such as the right to live in a corruption-free environment and to a proper public administration. Therefore, we argued that the prosecutors should recognize TOJIL as a victim of corruption for being a member of Mexican society, particularly as a human rights defender focused on combating corruption and impunity. However, the prosecutors denied our request.
